Al Ain Court Dismisses Woman’s Lawsuit Against Ex-Husband Over Alleged Loan Dispute
The Al Ain Court of Civil, Commercial, and Administrative Cases has dismissed a lawsuit filed by a divorced woman against her ex-husband, in which she demanded Dhs297,925, claiming it was a loan she had transferred to him. The woman presented bank transfer statements and account records as evidence, seeking a 12% delay interest, Dhs50,000 compensation, and coverage of legal fees and expenses.
Court Ruling and Key Arguments
The ex-husband’s lawyer countered the claim, highlighting that a previous ruling had already ordered the plaintiff to pay Dhs80,000 to her former spouse. The court examined the witness testimonies provided by the plaintiff but found them insufficient to establish the alleged loan agreement.
Additionally, the court pointed out that the financial transfers were made in installments over various dates, suggesting multiple possible reasons for these transactions. Given the lack of conclusive evidence, the court dismissed the lawsuit, stating that the plaintiff had failed to substantiate her claim.
Legal Precedents and Final Verdict
The court emphasized that financial disputes between former spouses must be supported by clear and legally binding evidence. Since the plaintiff could not prove that the transfers were loans rather than voluntary payments, the case was rejected in favor of the ex-husband.
This ruling reinforces the importance of documented agreements in financial transactions, particularly in disputes arising after divorce.
