Abu Dhabi Court's Verdict on Financial Dispute
The Abu Dhabi Family, Civil and Administrative Cases Court has ruled that an individual must pay Dhs233,513 to a former partner and friend. This decision was reached after the defendant repeatedly delayed fulfilling financial obligations, which were initially agreed upon in good faith.
Lawsuit Details and Financial Claims
The plaintiff filed a lawsuit seeking Dhs470,450, along with a 9% legal interest from the lawsuit date until full payment. Legal fees and expenses were also demanded. This lawsuit stemmed from an agreement in which the defendant was to participate as a project partner but subsequently withdrew Dhs500,000.
The complainant provided the defendant with the amount in instalments. Despite receiving the money, the defendant did not adhere to the agreed terms, repaying only Dhs29,550 in monthly instalments of Dhs3,000. The plaintiff claimed that the defendant neither fulfilled his financial obligations nor executed the intended project.
Evidence and Court's Consideration
The court's decision relied on various pieces of evidence, including WhatsApp messages and money transfer receipts. These documents illustrated the financial relationship between the parties. The defendant argued that their relationship involved simple financial transactions without any intention of establishing large projects or borrowing significant sums.
Technical Expert's Findings
A technical expert was appointed to review the case, and the report confirmed that WhatsApp messages showed the defendant acknowledged receiving sums totaling Dhs275,000. This included Dhs150,000 for a credit card bill and Dhs125,000 for a debt the defendant promised to repay.
Final Judgment
After assessing all communications and financial exchanges, the court determined the defendant owed Dhs233,513. The court's decision was heavily influenced by the expert's findings and the defendant's partial repayment of Dhs41,487.
