THE NEW MARINE LIFE PROTECTION ACT OF THE SALARY IN THE UAE WILL COME INTO FORCE IN OCTOBER
Since October in the United Arab Emirates the new law which will push additional liabilities for employers to employees on timely payment will be entered.
The decree No. (739) of 2016 about protection of the salary issued by the Ministry of human resources and emiratization of the UAE (MOHRE) will come into force since October, 2016.
New rules will offer expanded remedies of workers. According to experts, by means of this MOHRE tool will be able effectively to control a condition of timely payment of salaries and to punish violators.
The salary is considered late if it arrived later, than in 10 days after the fixed term registered in system of protection of the salary (WPS). WPS — obligatory system of wire transfer of the salary which allows the ministry to perform monitoring of payments in a private sector.
The companies with the state exceeding 100 people, and the companies which saved up more than one violation within a year can lose permission to employment of new employees if the salary isn't paid by them within 16 days from the moment of the expiration. If the payment delay remains within a month, the Ministry will inform judicial authorities and any other instances which have the right to take measures up to suspension of operations of other companies connected with the same employer and also refusal to register any additional organizations addressed to the violator.
Besides, if the salary doesn't go to the receiver within 60 days from the moment of the expiration, for each worker responsible will be fined 5 thousand dirhams ($1360). The maximum size of a penalty on this violation can reach 50 thousand dirhams ($13,6 thousand).
